These Terms & Conditions (“Terms”) govern your access to and use of https://sekaira.com and related services operated by Sekaira (“Sekaira”, “we”, “us”, or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Sekaira is a global platform. Users in all countries may browse, register, list servers, and use community features where permitted by law. Nothing in these Terms limits mandatory consumer or privacy rights that apply to you in your home country.

Please also read our Privacy Policy and Refund Policy, which are incorporated into these Terms by reference.

1. About the Service

Sekaira is an online discovery platform for game communities and server listings. We help players find worlds to join and help owners present their communities. Features may include game catalogues, server listings, rankings, voting, reviews, a community forum, owner dashboards, analytics, optional Discord integrations, and paid featured placement.

We are not a game host. We do not operate the game servers listed on the platform, do not guarantee server uptime or quality, and are not responsible for in-game conduct, economy, or data handled by listing owners or third-party games.

2. Eligibility and global access

You must be at least 13 years old to use the Service, or older if a higher minimum age applies in your country or region (for example 16 in some EU/UK contexts where local law requires it). If you are under 18, you represent that you have permission from a parent or legal guardian.

You may use the Service from anywhere in the world except where:

your local laws prohibit you from using an international online directory or community platform;
you are subject to sanctions or export restrictions that prohibit access; or
your account has been suspended or terminated by us.

You are solely responsible for complying with laws, regulations, and tax obligations in your country, including rules about online communities, advertising, data protection, and digital purchases.

3. Account registration

To access certain features (such as posting in the forum after email verification, managing listings, or purchasing featured placement), you must create an account with accurate information.

You agree to:

provide truthful, current, and complete registration information;
maintain the security of your password and account;
notify us promptly of unauthorised access; and
accept responsibility for activity under your account, except where caused by our fault.

We may refuse registration, reclaim usernames, or suspend accounts at our discretion for policy violations, abuse, or risk to the platform.

4. Email verification and communications

Some features require a verified email address. We may send transactional messages (verification links, password resets, purchase confirmations, security notices). You are responsible for keeping your email address current.

5. Listings and owner responsibilities

If you create or manage a listing, you represent and warrant that:

you have authority to promote the server or community;
your listing content is accurate and not misleading;
your server and community comply with applicable laws and platform rules;
you own or have rights to media and trademarks you upload; and
you will keep connection details, links, and descriptions reasonably up to date.

You grant Sekaira a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute your listing content solely to operate and promote the Service (including thumbnails, search results, and featured areas).

We may remove, edit, or reject listings that violate these Terms, appear fraudulent, or pose risk to users or the platform.

6. Voting

Voting helps surface popular listings. You agree not to manipulate votes through bots, multiple accounts, VPN abuse, purchased votes, or other artificial means. We may use technical measures (including hashed IP addresses, account linkage, and fingerprint data) to enforce vote intervals and detect abuse.

Vote rewards or in-game callbacks configured by listing owners are provided by those owners, not by Sekaira. We are not responsible if a callback fails or a reward is not delivered.

7. Reviews and forum content

Reviews, forum threads, replies, and similar content (“User Content”) must be lawful, honest, and respectful. You retain ownership of your User Content, but grant us the licence described above to operate the Service, including moderation and display.

You must not post content that:

is unlawful, defamatory, harassing, hateful, or sexually exploitative;
infringes intellectual property or privacy rights;
contains malware, spam, or deceptive links;
doxxes or threatens others;
impersonates another person or misrepresents affiliation; or
promotes scams, cheats, or illegal activity.

We may remove User Content or restrict accounts without notice where necessary. Forum posting may require verified email; staff may bypass certain restrictions for operational reasons.

8. Featured placement and paid services

We offer optional paid featured listing placement for a fixed period (currently 30 days at A$9.99, subject to change). Featured placement may appear in designated homepage or featured areas.

Important: Featured placement is promotional visibility only. It does not alter organic ranking scores, vote weight, or editorial quality metrics. Purchasing featured placement does not guarantee traffic, players, revenue, or listing approval.

Payments are processed by Stripe and may be presented in the currency shown at checkout (which may differ from your local currency). By purchasing, you also agree to Stripe’s terms and our Refund Policy (all sales are final except where non-excludable law in your country requires otherwise).

9. Acceptable use

You agree not to:

use the Service for unlawful purposes;
attempt to gain unauthorised access to accounts, systems, or data;
scrape, crawl, or harvest data at scale without written permission;
interfere with or disrupt the Service or its security;
reverse engineer client-side code except where permitted by law;
misuse reporting tools or submit false abuse reports; or
use the Service to distribute unsolicited advertising outside permitted areas.

10. Moderation and enforcement

We may investigate violations and take action including warnings, content removal, feature restrictions, suspension, or permanent bans. Moderators and administrators may act on reports, automated signals, or staff review.

11. Intellectual property

The Service, including its design, branding, logos, software, and original content (excluding User Content and third-party listings), is owned by Sekaira or its licensors and protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works from our platform materials except as allowed by law or with our written consent.

Game names, logos, and trademarks appearing in listings belong to their respective owners. Sekaira is not affiliated with or endorsed by those rights holders unless explicitly stated.

12. Third-party services and links

The Service may link to third-party websites, Discord servers, payment providers, or game clients. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Listing information is provided by owners and third-party queries; we do not guarantee accuracy, availability, or safety of any listed server.

Nothing in these Terms excludes, restricts, or modifies guarantees, rights, or remedies that cannot be excluded under the Australian Consumer Law, EU/UK consumer law, US state consumer laws, or other mandatory protections in your country.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Sekaira AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100 (or the approximate equivalent in your local currency at the time of the claim).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the minimum extent permitted by law.

15. Indemnification

You agree to indemnify and hold harmless Sekaira from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your listings or User Content, your violation of these Terms, or your violation of any third-party rights.

16. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access, with or without notice, for conduct that we believe violates these Terms or creates risk.

Sections that by nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

17. Changes to the Service or Terms

We may modify the Service or these Terms at any time. We will update the effective date when Terms change. Material changes may be announced on the website or by email where appropriate. Continued use after changes become effective constitutes acceptance.

18. Governing law and international users

These Terms are governed by the laws of South Australia, Australia, where our operator is based, without regard to conflict-of-law principles.

If you access the Service from outside Australia, you do so on your own initiative. Mandatory consumer protection, privacy, and refund laws in your country may still apply to you and are not overridden by this choice of law, to the extent they cannot be contractually waived.

Subject to mandatory local rights, you agree that disputes will be brought in the courts of South Australia, Australia. Nothing prevents a consumer in the EU, UK, or other regions with non-waivable forum rules from bringing proceedings in their home courts where those laws allow.

19. Dispute resolution

Before commencing formal proceedings, you agree to contact us at help@sekaira.com and attempt to resolve the dispute informally within 30 days.

EU/UK consumers may also use the European Commission’s Online Dispute Resolution platform or local alternative dispute resolution schemes where applicable. US users may contact their state attorney general or consumer protection agency for guidance on local remedies.

20. General

Entire agreement: These Terms, the Privacy Policy, and Refund Policy are the entire agreement between you and us regarding the Service.
Severability: If any provision is unenforceable, the remainder stays in effect.
No waiver: Failure to enforce a provision is not a waiver.
Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or asset sale.
